developing story out of oakland. police looking for the men who shot and injured a police officer. at least one person is in custody and this one happened last night on seminary avenue near east 17th. "today in the bay's" christie smith joins us live from that scene which is still shut down. at this hour you are out there checking it out what do we know about suspects? >> reporter: we know at least one is in custody but they are looking for two more. oakland police are being thorough with this one. this shooting happened nearly 12 hours ago. i spoke with a sergeant on scene and what he's telling me is the door to door search is basically over and what they're doing right now is combing the area looking for evidence. there is a dark vehicle you see there. that's a s.w.a.t. vehicle. the stretch of seminary avenue closed behind crime scene tape. neighbors staying mostly inside their homes this morning as you mentioned one man in custody. investigators are still looking for two more gunmen after an

officer was shot in the arm last night before 6:30. he was sitting in a car when he was confronted by three men. it's unclear if that officer fired back. he was investigating a shooting in the area from sunday. overnight a massive manhunt with chp helicopters and s.w.a.t. teams involved. that one man was detained and a gun was recovered at the scene. unclear if that's the one used to shoot at the officers though. that officer taken to the hospital and is expected to recover. i asked officers on scene how long they might be out here and they said at this point they still just don't know. reporting live in oakland, i'm christie smith, "today in the bay." >> this latest shooting comes as the city council is considering a $250,000 contract for an outside security consulting team. you have had a chance to look into this. why is it so controversial? >> reporter: they are looking into hiring bill bratton. this security contract will cost

$250,000. there was a public safety meeting last week and a lot of people in oakland came out. they were upset because he supports a stop and frisk policy. they believe that will lead to racial profiling and in fact the police chief came out in support of bratton and was shouted down by the crowd. very controversial. the public safety committee said yes, they want to go ahead and go with it. violent crime is up 23% here in oakland. really tonight it's up to the full city council and they ultimately have to make the decision. >> intriguing decision there. we'll keep our eye on it. thank you very much. just in three suspects now under arrest accused of kidn kidnapping a man from his home at gunpoint. petaluma police say they spotted suspects in a car leaving the victims' home yesterday. police found the victim inside the car and found a loaded handgun and some meth. the three suspects are being held on $5 million bail. meantime, in the east bay, two families robbed at gunpoint inside their own homes and now

piedmont police say those robberies may be linked. both homes were hit within 20 minutes of each other monday. the first on estates drive and second near arrayo avenue. one of the suspects shot at the victim but missed. the suspects took off in a newer model silver or gray suv which may have had damage to the left front end. an elderly couple tied up while their home is being ransacked and the search is on for robbers that got away with the victims' cars. this happened on bret harte drive. a normally very safe area that's just become a very nervous one. that is where "today in the bay's" arturo santiago joins us live. arturo, how is this couple after that scary night, how are they holding up this morning? >> reporter: we're told that they are still doing okay, jon. this happened yesterday. any sign of police activity has since disappeared. there are sure to be lingering effects on the neighborhood

throughout the day. this isn't very far from leyland high school. last night three men broke into the home of this elderly couple on the 6700 block the bret harte drive. they stole a number of items from the house after they drove off in two of the victims' cars. one of the victims was able to break free, get to a neighbor's home and call for help. nbc bay area talked to a woman who lived in the neighborhood for 16 years and has never seen this kind of crime in the area. >> freaked me out and scared me. i think like everyone it's not the type of thing that we expect and i don't know how they profiled or how they were chosen and that's frightening. >> nerves are shot. s they are shocked. they are holding up pretty well. >> reporter: police are still

looking for the couple's cars. one is a 1997 tan toyota camry with license plate 3ung960 and a green highlander 5xiu520. police say if you have any information call san jose police. live in san jose, i'm arturo santiago, "today in the bay." it is 6:06 now. bmw, jaguars and measurrcedes a some of the cars thieves managed to drive away. the suspects manageded ed td t off with a dozen cars yesterday morning. the thieves broke open a gate and then into an office and found keys. surveillance tape shows four or five people are involved. so far just one car has been recovered. investigators say the cars taken were worth hundreds of thousands

of dollars. today another public meeting is set to explain the public safety impact of closing several east bay firestations. contra costa county fire officials meeting with walnut creek residents tonight at 7:00 at walnut heights elementary school. they are expected to discuss the closure of firestation 4 and how those services will be impacted. in total four stations in walnut creek, clayton and lafayette will all be shut down as part of a countywide plan to trim a $17 million budget gap. good morning to you. it's 6:07. still an hour or so away until the sun comes up. let's get a look at the forecast with christina loren. good morning. >> good morning. the official sunrise time will be 7:20. the sun we will set at 7:22. about ten hours of sunlight. it's dark but no fog to show you in san francisco. in fact, we do have to show you a flag blowing in the breeze. the 49ers congratulations.

and that crash is now clearing over toward that treasure island off-ramp and so that's why we had earlier metering lights here at the toll plaza causing the early backup. kept that bridge at least moving better than stopped up. bridge itself, let's look at the incline. you see the lights are packed all of the way up toward treasure island. once you reach that tunnel things clear. the crash just moved to the treasure island off-ramp and city side moving smoothly. lower deck a stall now approaching the toll plaza getting off on oakland side. here's a south bay north 101 second issue we're following is northbound approaching 680 interchange. you see good volume here. map shows you we do have an incident, disabled bus approaching 680 northbound slowing from tully approaching the scene and slowing down because of volume of traffic and also because of a new accident north 101 at taylor at the top of your screen. added distraction in a congested area. folks will ditch out of the backup and take north 280 to 87 causing more slowing.

there's the rest of your south bay with pretty nice easy drive for the rest of the area. back to you. >> thanks, mike. this just into our newsroom. 12 people in southern california in the hospital this morning after a fire at a san pedro motel there. firefighters fighting this blaze. a police officer was hospitalized for smoke inhalation after trying to get into this thing to help people escape that building. three of the victims were critically injured. no word yet on the cause. we'll keep you updated as more information comes into our newsroom. pretty scary scene out there. you can see a very fluid situation. it's 6:10 now. the woman whose picture was used to trick manti te'o speaks out. why you may have to mine for gold if you want to be in the stadium to see the 49ers play on football's biggest stage.

lucky 49er fans will find out today if they'll get a chance to be down in new orleans for the team's quest for number six. they will find out today by e-mail whether they won a team drawing that will allow them to purchase super bowl tickets. the team entering every season ticket holder into the drawing earlier this week and winning only guarantees you the chance to buy tickets from the team. the team says it will not have any individual tickets for sale and they are suggesting using a certified ticket broker and you can expect to pay at least $2,000 per ticket if you are lucky. some people not going to the game but they still want to soak

searching for two suspects who shot and undercover cop near the coliseum. three men confronted the officer and shot him in the arm. one person is in custody. the officer is expected to recover from his injuries. a san jose neighborhood right now on edge after burglars broke into a home, tied up the elderly residents, robbed them and then stole their cars. this all happened near leyland high school. more dreamliner flights out of san jose have been canceled as japan's all-nioppon airlines investigate the aircraft. all flights canceled through january 28th and the airline says more consolations are possible. southwest airlines announcing changes to the way it lines up passengers. >> scott mcgrew thought he had the system beat. when he heard there were changes he looked into this for all of us. >> good news. i got off the phone with southwest. they clarified this morning's news. they are actually keeping the $10 early bird system. you pay 10 bucks when you buy

the ticket and you don't have to check in and you get a ticket automatically. what did change is they'll start selling a $40 option right at the gate. if they don't have enough people to fill their business select line, you can buy a business upgrade at the gate. that's new. but the $10 early bird automatic check in still exists. as you may know, southwest doesn't have assigned seats. if you want a window seat or aisle, make sure you're in the first group to be on the plane either by showing up early or paying to jump the line. keep your seat belts fastened for apple. bloomberg speculating that apple may see a decrease in profit quarter to quarter. that hasn't happened in ten years. we have to reach all of the way back to friday to get google's opening price. markets close to dr. king's birthday on monday. google reports profits after the closing bell today. walmart changed its policies giving manufacturers no second chances when it comes to safety. this after a terrible fire in

bridge, berkeley curve is jammed up heading to the bay bridge or even south heading to oakland. you'll slow down right there at the exchange. this is a big problem because of two earlier incidents on the upper deck which have cleared but the damage is done. there's your backup. there's your wait. we'll get you a look further south looking at castro valley y. a typical pattern. that's better news. coming south through san mateo bridge. 580 not a problem as far as build. nothing unexpected for livermore or pleasanton. 680 moves nicely but north 101 approaching the area a disabled bus in the slow lane. chp and freeway service patrol try to help out. earlier accident at taylor causing more distraction and backup. this is why i was concerned about north 280 off 680 heading into downtown. we may see traffic. waiting for this to shake out. there's 87 showing the slowdown in the northbound direction.

it is 6:30. very good morning to one and all. thank you for getting up early with us. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. a quick update now on a developing story. an undercover officer is recovering after being shot in the arm. police have spent all night going door to door in a search for the men who confronted the officer and opened fire. one person has been arrested. two more or still on the run. the officer is expected to survive. meanwhile, in san jose, police are searching for two men who tied up an elderly couple before ransacking their home on bret harte drive close to leyland high school. the suspects stole the couple's cars. no arrests have been made. we have reporters at both scenes gathering information. both will have updates in about 15 minutes. following the festivities, a new day in washington.

president obama starting a new term with a new congress in place. "today in the bay's" tracie potts joins us live in washington d.c. trace tracie, a busy first if you years. what's first on the agenda? >> reporter: the president laid out a number of things in his inauguration speech that he wants to deal with. a broad agenda. he talked about immigration reform, gay rights, climate change. the first big thing on the agenda and he mentioned this is the financial situation of this country. the debt and deficit. starting tomorrow the house is going to deal with this. a vote coming up about the debt ceiling. in other words, they want to raise the debt cerealing ingce. they say that democrats are going to have to in the senate pass a budget or they won't get paid. it's part of the vote coming up. senate democrats being pressured to deal with the budget in a

comprehensive way and not two months at a time although this measure they are voting on for the debt ceiling raising the debt ceiling would really only last until spring. still sort of a piecemeal approach while both sides say they want to do more comprehensive approach similar to what the president laid out but haven't worked out details. >> we'll find out if pressuring their pocketbooks will help out here. the question for you here, why is the vote set for tomorrow and what group do you see most under pressure? >> reporter: they need to deal with this quickly. the treasury department said unless we borrow more money come mid february we won't be able to pay bills. the house has to vote on it. senate has to vote on it. work out kinks and get it to the president's desk before that time and it's coming up in a few weeks. in terms of who is under the most pressure here, democrats or republicans, the republican party sort of relented in what they were going to originally do with the debt ceiling. it looks like they may be

feeling some of the pressure. public according to the polls that we've seen is fed up with washington in general. >> nothing short of a monumental weekend out there on capitol hill. you were front and center for all of it there. we understand also there's still one inauguration event left for today for both the obamas and the bidens, right? >> reporter: they are going to the prayer service. it's a national day of prayer. another sort of traditional thing that happens after inauguration but then back to work. >> all right. tracie potts, nice work out there. busy weekend. we appreciate it. >> thanks. new this morning, a couch now just a pile of charred rubble after a fire started at a furniture outlet in fremont. firefighters say a working sprinkler system kept the flames from spreading any worse than they already did. firefighters are still trying to figure out the cause of that fire. today caltrans starts work to repair sections of that bay bridge damaged when it was hit by an oil tanker earlier this month. starting this morning the agency

will spend as much as $3 million in taxpayer money to replace fenders on that western tower that were sideswiped on january 7th. officials say the actual pier itself sustained no damage as a fender system worked absorbing the impact. the repair work expected to last 4 1/2 months. caltrans may be able to recoup some of that money and the repair money there pending outcome of the ntsb and coast guard investigation. >> good morning to you. we want to check the forecast with meteorologist christina loren. good morning. >> good morning to you, jon and marla. good morning to you at home. this is what is greeting you when you walk out your front door. a spectacular start to the day. we have a few high clouds but overall looking mostly clear to start. beautiful shot over the san francisco bay this morning. 42 degrees in the city right now. in san jose we're at 38 degrees. it's cold out there. grab your heavy coat. 30 in gilroy. as we head throughout the day today, you can peel it off by noon.

moderate air quality so some improvement in that department. hour by hour detail works like this for today. your full forecast just a few moments away. first, want to look at your drive. good morning, mike. >> good morning. let's take you right out there for the live look in palo alto. we do have an issue. even though we show northbound with these headlights just fine coming past university avenue, we do have an issue just a little farther north heading through san mateo now just into chp. still not a lot of details but it does sound like we have something that may be in the lanes either a disabled vehicle or a minor accident there. we'll follow that. reports coming in. a smooth flow as far as sensors are concerned. taillights move smoothly to the south and slowing going on for northbound 101. 87 and 85 also kicking in. this is relatively gradual for a tuesday but we'll see that really kick in for the south bay over the next hour. northbound 101 approaching that 680 interchange still a report of a disabled bus. haven't seen much more effect on it than slowing approaching the

new this morning, a 5.4 magnitude quake rocking parts of western indonesia this morning. that quake sadly killed a 9-year-old girl, injured several other people and ruined homes there. a magnitude 4.5 tershock followed just a few minutes later. happening now, fire crews spent all night fighting to contain a fire at beale air force base. it's about 50 miles north of

sacramento. firefighters say they have it about 75% contained now. the fire broke out around 2:30 yesterday inside a building on that base. a firefighter has been hurt but is expected to survive. the cause is under investigation. we have new details this morning about what may have led to a teenage boy shooting and killing his parents and three young siblings. sheriff's deputies in new mexico say the 15-year-old boy was annoyed with his mother and had been having homicidal and suicidal thoughts. the boy even took a picture of his bed mother and sent it to his girlfriend. nothing short of a tragic scene there. deputies say that boy had initially planned on driving to a nearby walmart to shoot more people. he told investigators he planned to die in a shootout with law enforcement. it's 6:40. still ahead, manhunt. oakland officers lock down city streets after one of their own is shot on the job. an elderly couple tied up as their house is torn apart there

the latest now on a developing story in oakland where the search continues for two men accused of shooting and injuring an undercover police officer. this morning police are still out at that crime scene collecting evidence on seminary avenue near east 17th street. "today in the bay's" christie smith joins us live from the scene. good morning. how is the officer doing this morning? >> reporter: well, he was taken to the hospital and is

recovering this morning but this has been a long night for the oakland police department. they are still here investigating 12 hours after that officer was shot in the arm and wounded. still searching for evidence. they are focusing on an apartment building just up the street. it looks like they may be wrapping up. they are loading up their equipment and a tow truck is here to remove a car from the car scene. four blocks of this neighborhood have been on lockdown. officers going door to door on seminary avenue looking for two gunmen on the loose. this started last night around 6:30. three men got into a confrontation with an undercover oakland police officer in a car investigating a shooting that happened on sunday. that officer hit in the arm. one man detained and again a gun also recovered from the scene. police saying they don't know at this point if that gun was actually the one fired at the officer. i asked how long they might be here and they really couldn't give me an answer.

i can tell you that i did hear from the oakland police department this morning and they are planning to update us at a press conference at 9:30 this morning. reporting live in oakland, christie smith, "today in the bay." >> before we let you go, some interesting timing here. this latest shooting comes as the city council is considering a $250,000 contract for an outside security consulting team. this doesn't come without controversy. why is this? >> reporter: absolutely not. that team is bed ed by bill bratton. one of the things that he supports is a policy called stop and frisk. and when that was brought up at a public safety committee last week, there was a lot of public outcry. many people thinking this might lead to some sort of racial profiling if it were used in oakland. the mayor saying she supports bringing in bratton and so does the police chief here in oakland at a cost of $250,000. public safety committee gave its go ahead but tonight it's actually the full city council that will have to make that

decision. >> okay. thanks so much. we'll obviously continue to follow this story. oakland city council will consider a graffiti enforcement ordinance that has angered some business owners. the ordinance which received preliminary approval last month seeks harsher penalty for taggers including jail time. the issue is with new signs on businesses that fail to remove the graffiti within 15 days. opponents say the ordinance unfairly targets the victims of graffiti. the city council is expected to take a final vote on this issue tonight. tonight at 6:00, a special community meeting taking place and being held to talk about equipping san francisco police officers with tasers. the chief wants to give officers 100 of those weapons and new training on how to better deal with mentally ill suspects. the proposal was after a officer shot and killed a man armed carrying a box cutter last year.

amount of particulate matter in our atmosphere. moderate air quality expecting that to dramatically improve as we head through tomorrow with showers on the way. 42 degrees in san francisco. a dry month so far. 30 in gilroy. 38 degrees in san jose. so an indication of more moisture in our atmosphere. we're noticing visibility dropping off not so much to the point where you have to worry about rolling through deep pockets of fog on the way to work. we do have tule fog creeping in over the central valley. looking good to start your tuesday. we stop the clock on future cast as of noon. this afternoon it will get on the cloudy side. more clouds than sun by the end of the day. by 5:00 a.m. tomorrow morning, foggy, drizzle, it's back in the works. by 11:00 a.m. our first showers into the north bay. stop the clock by 6:00 p.m. steady rainfall over the greater bay area. we'll clear out between 7:00 and 10:00 and on thursday a dry day before the storm window opens up into the weekend.

enjoy 69 degrees while it lasts in gilroy. 68 in san jose. and 67 degrees in fremont. it doesn't look like we'll hit this kind of warmth again potentially for the next couple weeks. we need the rain. it's that time of year. we'll collect anything we can get. 63 degrees by thursday. 62 for friday. saturday, sunday, that storm window opens up. first storm and then another one comes through late monday into tuesday. wednesday of next week also looking pretty wet. the pattern changing yet again. that drive always changing. let's find what's happening with mike inouye. >> peninsula drivers first. a beautiful sunrise to show you. redwood city, menlo park. northbound 101 out of menlo park up into redwood city is clear right here. you head into this backup on my map. i'll show you that san mateo heading up into burlingame we have a slowdown because of an earlier crash sticking out blocking one lane at peninsula. it happened very quickly as far as backup as a burst of traffic came over the bridge and that's what's causing that slowing.

that's it for the peninsula. the south bay also shows the build here. the two earlier incidents off of the roadway but still a distraction slow 101 from capital to the airport. 87, 85 and 280 kicking in per normal pattern but we'll see traffic downtown as san jose is back in full effect. southbound drive for the east bay here. 880 from hayward, union city and fremont. slow build continues past bowl bridges. 680 off 580 through sunol shows volume increasing but nothing unexpected for tri-valley commute. the approach through the maze is smooth including the caldecott tunnel. folks are jamming into emeryville and around the bend to the bay bridge, 580 also very slow coming off the maze so those two areas because of earlier crashes on the bridge itself they got extra congested. those bridge incidents have cleared from the upper deck. we'll look at the north bay

where the smooth drive southbound picking up a lot of company. slowing from novato into san rafael and from san rafael into the city. slowing through marin county. nothing big so far. back to you. >> mike, thank you very much. next, a scary scene. elderly couple tied up while their home is ransacked and this morning the hunt is on for the suspects. this all happened in what many consider one of the safest parts of san jose on bret harte drive knee leyland high school. arturo santiago joins us live from that scene. what are neighbors out there telling you about a traumatized couple here, the victims? >> reporter: they are doing okay now according to police, jon. we are about a block away from leyland high school. for people familiar with this area, it's a quiet part of suburbia which is why it's surprising this crime has happened here and the neighborhood hit hard by it. the crime happened last night when three armed men broke into

the home of this elderly couple and tied that couple up as you mentioned and then proceeded to ransack the home and steal a number of items from the house and then the suspects drove off in both cars belonging to the victims. one of those victims was able to break themselves free and get to a neighbor's home and call for help. again at last word that couple is doing okay. police are trying to track down the stolen cars. one is a 1997 tan toyota camry license plate on that one is 3ung960. the other is a 2007 green highlander with a license plate of 5xiu520. if you have any information on these stolen cars or on the crime itself, please call san jose police. four teenagers seriously injured after being shot during a drive-by shooting. the teens range in age from 15

to 18 years old. all four were standing on the sidewalk near a home on breton drive when someone in a passing car began shooting. all four victims are expected to survive. police describe the car as a white or light colored late model four-door sedan. a couple high profile court hearings we are expecting. >> opening statements set for this morning in the retrial of former crime lab technician deborah madden. madden is akuccused of stealing cocaine held as evidence in other crimes. the story forced the district attorney who drop hundreds of criminal cases. the first trial ended in a hung jury last fall. a hearing set today for the san francisco sheriff's deputy accused of robbing a bank in the city's richmond district back in november. police say he entered that bank on balboa treat and handed the note to the teller demanding money saying he had a weapon.

the teller handed over $1,700 in cash. a retired catholic cardinal in the los angeles dioceses now accused of working behind the scenes to shield child molester priests. that accusation was contained in a new lawsuit against the archdiocese based on newly released church files. notes written by cardinal roger mahoney show he was disturbed by abuse allegations and set problem priests for psychiatric treatment but mahoney kept in contact with abusive priests when they went through treatment out of state and worked to keep them out of criminal alifornia criminal and civil penalties. mahoney says he's been naive about lasting impacts of abuse. all-nioppon airlines will cancel more dreamliner flights from san jose to japan. the flights are canceled through january 28th. the airline says more cancellations are possible.
